dc.descriptionThe monograph is devoted to a comprehensive study of judicial protection of intellectual property rights in the economic sphere. The general principles and concepts of judicial protection of intellectual property rights in the economic sphere are examined, and on the basis of identifying characteristics, a clarification of the definition of this concept is proposed. Independent objects of judicial protection in the sphere of intellectual property rights enforcement by economic entities are identified. The most typical types of legitimate interests with their own means of protection are revealed. The legislative basis for the judicial protection of rights and legitimate interests in the analysed sphere is studied and specified. The model of legislative regulation of the High Court on Intellectual Property Issues has been clarified. The grounds for the protection of intellectual property rights in the economic sphere and the classification of violations of property rights to intellectual property objects have been elaborated. The concept of counterfeiting in the sphere of industrial property has been proposed. The objects of protection have been studied and differentiated in accordance with the legislation on unfair competition and special laws on the protection of intellectual property rights. Measures to identify and eliminate the causes of intellectual property rights violations have been highlighted. The signs of non-recognition and contestation of intellectual property rights have been specified. The issue of compensation for non-pecuniary losses (moral damage) has been studied and scientifically substantiated. Some special methods of protecting intellectual property rights have been clarified and refined. The need to apply standards of evidence in commercial cases in the field of intellectual property has been substantiated.
dc.description.abstractМонографію присвячено комплексному дослідженню судового захисту прав інтелектуальної власності у сфері господарювання. Досліджено загальні засади і поняття судового захисту прав інтелектуальної власності у сфері господарювання та на підставі виокремлення ознак запропоновано уточнення визначення цього поняття. Виокремлено самостійні об’єкти судового захисту в сфері реалізації прав інтелектуальної власності суб’єктами господарювання. Виявлено найбільш типові види законних інтересів з власними способами захисту. Досліджено і конкретизовано законодавчу основу судового захисту прав та законних інтересів в аналізованій сфері. Уточнено модель законодавчого регулювання Вищого суду з питань інтелектуальної власності. Опрацьовано підстави захисту прав інтелектуальної власності в сфері господарювання, класифікацію порушень майнових прав на об’єкти інтелектуальної власності. Запропоновано поняття контрафакції у сфері промислової власності. Досліджено і розмежовано об’єкти захисту відповідно до законодавства про недобросовісну конкуренцію й спеціальних законів про охорону прав на об’єкти інтелектуальної власності. Виокремлено заходи з виявлення та усунення причин порушень прав інтелектуальної власності. Конкретизовано ознаки невизнання прав і оспорювання прав інтелектуальної власності. Досліджено питання відшкодування втрат немайнового характеру (моральної шкоди) та зроблено наукові обґрунтування. Уточнено та доопрацьовано деякі спеціальні способи захисту прав інтелектуальної власності. Обґрунтовано необхідність застосування стандартів доказування у господарських справах у сфері інтелектуальної власності.
