dc.descriptionThe article is devoted to the study of a topical aspect of the modern legal space – dispute reso-lution using technological innovations, where the Internet and technology determine new ap-proaches to dispute resolution. The relevance of the research topic is due to the development and implementation of technological innovations in all sectors of the economy. As trends show an in-creasing interest of participants in using online platforms to resolve conflicts and disputes in a con-venient and efficient manner, the article outlines some of the advantages of online dispute resolu-tion, including speed and efficiency, accessibility, low costs, and technological innovation. Atten-tion is also drawn to some of the difficulties of online dispute resolution, which include technical issues, security and privacy issues. It is emphasized that the effectiveness of online dispute resolu-tion may depend on the nature of the dispute, the level of cooperation between the parties, comp-liance with the principles of justice and other factors. The article explores and analyzes the ad-vantages and disadvantages of using online platforms to resolve various legal disputes. In parti-cular, attention is drawn to the wide range of platforms that provide these services and their role in ensuring access to justice, and that the effectiveness of these platforms may depend on the specific context and nature of the dispute. The practical aspects of the use of online platforms are explored, taking into account the current technological possibilities. The relevance of the topic is due to the determination of the effectiveness and limitations of these tools in comparison with traditional methods of dispute resolution. Proposals are made for the optimal use of online resources in legal practice. This article examines examples of successful cases of using online platforms and the pos-sibility of their implementation in Ukraine. Attention is drawn to examples of platforms that are already successfully implementing online dispute resolution in business, trade and other industries. The author concludes that it is advisable to adopt foreign experience in regulating online dispute resolution platforms.
dc.description.abstractСтаття присвячена дослідженню актуального аспекту сучасного правового простору – вирішенню спорів з використанням технологічних інновацій, де інтернет та технології визначають нові підходи до вирішення спорів. Актуальність теми дослідження зумовлена розвитком та впровадженням технологічних інновацій в усі сфери економіки. Оскільки тен-денції показують зростання зацікавленості учасників у використанні онлайн-платформ для вирішення конфліктів та спорів зручним і ефективним способом, наведено деякі переваги онлайн вирішення спорів, які включають швидкість та ефективність, доступність, низькі витрати, технологічні інновації. Також звернута увага на деякі труднощі онлайн-вирішення спорів, до яких віднесено технічні питання, питання безпеки й конфіденційності. Акцентовано, що ефективність онлайн-вирішення спорів може залежати від характеру спору, рівня співпраці сторін, дотримання принципів справедливості та інших факторів. У статті досліджуються та аналізуються переваги та недоліки використання інтернет-платформ для вирішення різноманітних юридичних спорів. Зокрема, звертається увага на широкий спектр платформ, які надають ці послуги, та їх роль у забезпеченні доступу до справедливості, а також на те, що ефективність цих платформ може залежати від конкретного контексту і характеру спору. Досліджуються практичні аспекти використання онлайн-платформ, вра-ховуючи сучасні технологічні можливості. Актуальність тематики зумовлена визначенням ефективності та обмеження цих інструментів, порівняно з традиційними методами вирі-шення спорів. Висуваються пропозиції щодо оптимального використання онлайн-ресурсів у юридичній практиці. У цій статті розглядаються приклади успішних випадків використання онлайн-платформ та можливість їх впровадження в Україні. Звертається увага на при-клади платформ, які вже успішно впроваджують онлайн-вирішення спорів у сферах бізнесу, торгівлі та інших галузях. Зроблено висновок про доцільність перейняття іноземного досві-ду щодо регулювання онлайн-платформ для вирішення спорів.
